    Frequently asked questions about our mediation services

    Is mediation legally binding?

    Not initially. Parties will review and sign a Memorandum of Agreement following a successful mediation session with terms of either a full or partial agreement. Parties may take the signed Memorandum to Court or to their legal counsel. Once the terms of the agreement are filed with the Court and approved by the applicable judicial officer, i.e., judge or magistrate, the terms become enforceable by law.

    Can we use mediation after a divorce case has been filed with the court?

    Absolutely. Mediation can be accomplished at any stage, even if litigation is already underway.

    What if we are unable to agree on everything?

    Mediation can still help resolve many issues, even if parties are unable to agree on all terms, and a partial agreement is the best case scenario. Unresolved matters can be handled in court and limit the issues for trial, which will significantly reduce costs for parties.
