    Common Questions

    Frequently Asked Questions

Common questions about divorce and family law in Ohio

What are the grounds for divorce in Ohio?

The grounds for divorce in the state of Ohio are outlined in Ohio Revised Code Section 3105.01: "(A) Either party had a husband or wife living at the time of the marriage from which the divorce is sought; (B) Willful absence of the adverse party for one year; (C) Adultery; (D) Extreme cruelty; (E) Fraudulent contract; (F) Any gross neglect of duty; (G) Habitual drunkenness; (H) Imprisonment of the adverse party in a state or federal correctional institution at the time of filing the complaint; (I) Procurement of a divorce outside this state, by a husband or wife, by virtue of which the party who procured it is released from the obligations of the marriage, while those obligations remain binding upon the other party; (J) On the application of either party, when husband and wife have, without interruption for one year, lived separate and apart without cohabitation; (K) Incompatibility, unless denied by either party." We will help you determine the best approach for your situation.

    How is child custody determined?

Courts consider the child's best interests under a certain set of statutory factors as outlined in Ohio Revised Code Section 3109.04. We will help you present the facts of your case effectively to achieve the best possible child custody arrangement.

What happens to our property in a divorce?

Marital property is divided equitably. It is worth noting that equitable does not necessarily mean equal. The Court considers a myriad of factors like contributions, length of marriage, and future needs of each party. We help protect your interests in dividing the marital estate.

Do I need a lawyer for my divorce?

While retaining the services of a lawyer is not required, having legal representation is certainly advisable and best ensures your rights are protected and that paperwork is filed correctly. Let us take some of the burden away from you so that you can focus on moving forward.
